Returns, Refunds and Right of Withdrawal Policy

G Kennedy & Sons Ltd supplies agricultural machinery parts, components, consumables and related products to both business and private customers.

Most purchases through this website are made by farms, agricultural contractors, workshops, machinery businesses and trade customers. However, some purchases may be made by private consumers.

This policy explains the return, cancellation and refund terms that apply to purchases made through this website. Nothing in this policy affects rights that cannot legally be excluded or limited.

1. Business Customers and EU End Consumers

Business Customers

A business customer is a customer purchasing goods wholly or mainly for use in connection with their trade, business, farming activity, contracting activity, workshop, profession or other commercial operation.

Most orders placed through this website are business-to-business purchases.

Business customers do not generally have a statutory right to cancel an online order simply because they have changed their mind. Returns from business customers are accepted only where approved by G Kennedy & Sons Ltd under this policy, any agreed trade account terms, or another written agreement.

EU End Consumers

An EU end consumer is an individual purchasing goods wholly or mainly outside their trade, business, craft or profession, with delivery to an address in the European Union.

EU end consumers may have a statutory right to withdraw from certain eligible online purchases without giving a reason. This right is separate from, and takes priority over, our voluntary 30-day returns policy.

The statutory EU consumer withdrawal right does not automatically apply to business-to-business, trade, commercial farming, contracting or workshop purchases.

Where the status or purpose of a purchase is unclear, we may ask for further information before processing a cancellation or return request.

2. Cancelling an Order Before Dispatch

You may request to cancel an order before it has been fulfilled or dispatched.

The quickest way to request cancellation is through your customer account or order page using the relevant cancellation option.

EU end consumers may use the EU Withdrawal / Cancel Order option available through the website or customer account area.

You may also contact us at parts@gkennedyagrisales.com, quoting your order number.

A cancellation request is not automatically accepted where an order has already been fulfilled, dispatched, specially sourced, made to order, personalised, fitted, installed or otherwise cannot be cancelled under applicable law or agreed terms.

We will confirm by email whether your cancellation request has been accepted.

3. EU Consumer Right of Withdrawal

This section applies only to EU end consumers.

If you are an EU end consumer, you may have a legal right to withdraw from an eligible online purchase without giving a reason.

You can exercise this right:

  • at any time before your goods are dispatched; and

  • within 14 days after you, or someone nominated by you, receives the goods.

Where an order contains multiple goods delivered separately, the 14-day period begins on the day you receive the final item in that order.

To exercise your right of withdrawal, please use the EU Withdrawal / Cancel Order option in your customer account or order page. You will be asked to provide your name and order details and to confirm your request. We will send confirmation of your withdrawal request by email.

You may also notify us in writing by emailing parts@gkennedyagrisales.com with:

  • your full name;

  • your order number;

  • the items you wish to withdraw from; and

  • a clear statement that you wish to cancel or withdraw from the purchase.

You do not need to provide a reason for exercising your statutory right of withdrawal.

4. Returning Goods Following a Withdrawal Request

Once you have notified us that you wish to withdraw from an eligible purchase, you must return the goods without undue delay and no later than 14 days after notifying us.

Unless we have agreed otherwise in writing, returns should be sent to:

Please include your order number and contact details with the return.

You are responsible for the direct cost of returning goods unless the item is faulty, incorrect, damaged on arrival, or we have agreed to arrange the return.

We recommend using a tracked and insured delivery service for higher-value items. We cannot accept responsibility for goods lost or damaged in transit back to us.

5. Refunds for Statutory Withdrawals

For eligible statutory withdrawals, we will refund the payment received for the returned goods, including the cost of standard outbound delivery where required by law.

We are not required to refund any additional cost resulting from your choice of a delivery method more expensive than our standard delivery option.

Refunds will be issued using the original payment method.

For EU consumer withdrawal requests, we will process the refund within 14 days of receiving the withdrawal request. However, we may wait until we receive the returned goods or acceptable evidence that they have been returned, whichever happens first.

We may make a deduction from the refund where the value of returned goods has been reduced because they have been handled beyond what is necessary to inspect their nature, characteristics and functioning.

6. Our 30-Day Returns Policy

In addition to statutory rights that may apply, we offer a 30-day goodwill returns policy for most standard stock items.

You may request a return within 30 days of delivery where:

  • the item is unused;

  • the item is in resaleable condition;

  • the item is returned with all original packaging, components, instructions and accessories; and

  • you have proof of purchase or your order number.

This 30-day goodwill policy does not replace or reduce any statutory consumer rights.

For returns made under this voluntary 30-day policy, customers are responsible for return postage unless the item is faulty, incorrect or damaged on arrival.

Acceptance of a return under this voluntary policy is at the discretion of G Kennedy & Sons Ltd, particularly for business-to-business purchases.

7. Non-Returnable or Restricted Items

Some products may be excluded from our voluntary 30-day returns policy, or from statutory withdrawal rights where applicable law permits.

These may include:

  • goods made to a customer’s specification or clearly personalised;

  • specially ordered, non-stock or supplier-sourced items;

  • electrical or electronic components where packaging has been opened, fitted or altered;

  • parts that have been fitted, installed, used, damaged or modified after delivery;

  • goods returned without original packaging, where resale is not possible;

  • sealed goods not suitable for return for health, hygiene or safety reasons once unsealed;

  • products containing oils, lubricants, chemicals, aerosols, liquids or other regulated materials where return transport is restricted;

  • items clearly identified as non-returnable before purchase, where this is permitted by law.

Any exclusion applies only to the extent permitted by applicable law.

Your rights in relation to faulty, damaged, misdescribed or incorrectly supplied goods are not affected.

8. Faulty, Damaged or Incorrect Goods

Please inspect your order as soon as possible after delivery.

If an item is faulty, damaged, incorrect, or does not match its description, contact us promptly at parts@gkennedyagrisales.com with:

  • your order number;

  • a description of the issue; and

  • clear photographs where possible.

Please do not return a faulty item until we have provided return instructions.

Where a fault, damage or supply error is confirmed, we will arrange an appropriate remedy, which may include a replacement, repair, refund, collection or return arrangement, in accordance with your legal rights and applicable terms.

9. Exchanges

We do not offer direct exchanges through the online store.

Where you require a different item, please contact us at parts@gkennedyagrisales.com. Subject to stock availability and the condition of the returned item, we may arrange a replacement or advise you to place a new order once the return has been approved.

10. Sale and Clearance Items

Sale, promotional and clearance items remain covered by applicable statutory rights, including rights relating to faulty, damaged, incorrectly supplied or misdescribed goods.

Sale or clearance items may be returned under our 30-day goodwill policy unless they were clearly identified before purchase as non-returnable and that restriction is permitted by applicable law.

11. Business Customers

Where goods are purchased wholly or mainly for trade, business, agricultural, contracting, workshop or commercial use, the EU consumer withdrawal rights described in this policy do not normally apply.

Business customers should check product suitability, specifications, compatibility, part numbers and fitment before ordering. Where there is uncertainty, please contact us before placing an order.

We may, at our discretion, accept unwanted standard-stock goods from business customers under the 30-day goodwill returns policy. This does not create an automatic right for a business customer to cancel or return goods.

Special-order items, non-stock items, electrical components, fitted or installed parts, used items, goods with damaged packaging, and goods returned outside the stated period may be refused or may be subject to a handling or restocking charge where agreed with the customer and permitted by law.

Nothing in this section affects a business customer’s rights where goods are faulty, damaged, incorrectly supplied or materially different from the agreed specification.
